Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the KrptoPay website, applications, marketplace, APIs that may be made available to you, and related services (collectively, the “Service”). KrptoPay is operated by Ace Corporate Services, registered in Saint Lucia under registration number 2025-00823 (“KrptoPay”, “we”, “us”, or “our”).

By creating an account, accessing the Service, or continuing to use it, you agree to these Terms. If you do not agree, do not use the Service.

1. Scope of the Service

KrptoPay provides individual custodial wallets, fiat and crypto funding workflows, P2P trading with escrow controls, a services marketplace for buyers and sellers, and company custodial wallet onboarding for approved business use cases. Some features may be unavailable or limited based on jurisdiction, verification status, risk review, or product rollout stage.

2. Eligibility and Accounts

You must be at least 18 years old and legally able to enter into binding agreements to use the Service. You must provide accurate, current, and complete account information and keep it updated. You are responsible for safeguarding your credentials and for all activity that occurs under your account.

We may refuse access, impose limits, or close accounts when required for legal, compliance, fraud, security, or operational reasons.

3. Verification and Compliance

KrptoPay may require identity verification, source-of-funds review, sanctions screening, or additional compliance information before allowing access to certain features, higher limits, marketplace selling, or payout activity. Failure to complete required checks may result in restricted access, delayed processing, or account suspension.

4. Wallet and Funding Services

4.1 Wallet activity

KrptoPay supports custodial wallet activity across the chains and assets described on the platform. Deposits, withdrawals, exchanges, and balance changes are subject to product rules, confirmation thresholds, payment-method requirements, and risk controls.

4.2 Crypto transactions

Blockchain transactions are irreversible once confirmed on-chain. You are responsible for selecting the correct asset, network, and destination details. KrptoPay is not responsible for losses caused by incorrect addresses, unsupported assets, unsupported networks, or blockchain conditions outside our control.

4.3 Fiat transactions

Fiat funding and payout methods may depend on banking, payment, or payout partners. Processing times, review requirements, and method availability may vary by jurisdiction, payment method, currency, and risk profile.

5. P2P Trading

KrptoPay provides a P2P trading environment in which users may publish offers and enter trades with each other. KrptoPay is not a principal to those user-to-user arrangements. Our role is to provide platform controls, trade-state handling, reserved-balance logic, notifications, and dispute tools.

6. Marketplace Overview

KrptoPay Marketplace enables buyers to purchase services and sellers to publish service offerings using the same KrptoPay account and wallet. Marketplace orders are a separate workspace from wallet and P2P activity, but wallet balance may be used to fund an order.

KrptoPay is not the seller of listed services and does not become a party to the underlying agreement between buyer and seller. We provide the marketplace environment, order controls, support tooling, and payout logic.

7. Buyer Terms

  • Buyers must provide accurate requirements, instructions, and supporting information needed for service delivery.
  • Funding an order authorizes KrptoPay to commit the stated amount from the buyer’s wallet balance to that order.
  • Buyers must review deliveries in good faith and use revision, completion, cancellation, and dispute workflows responsibly.
  • Buyers may not abuse revisions, delay acceptance in bad faith, or attempt to move service work off-platform to avoid fees or controls.

8. Seller Terms

  • Sellers may be required to complete approval, verification, moderation, or visibility checks before publishing or receiving payout.
  • Sellers must publish truthful listings, accurate package scope, delivery commitments, and lawful services only.
  • Sellers must deliver their own work or properly authorized work and must not infringe intellectual property or third-party rights.
  • Sellers may not restore or bypass a restricted seller status through profile changes or listing edits.

9. Orders, Delivery, Revisions, Cancellations, and Disputes

9.1 Order flow

Orders may include buyer requirements, message history, delivery submissions, revision requests, completion actions, cancellation paths, refund handling, and dispute review. KrptoPay may preserve order records and communications for support, compliance, and audit purposes.

9.2 Revisions

Revision requests must relate to the purchased scope. Revisions do not create a right to materially expand the order beyond the seller’s listing or accepted terms.

9.3 Cancellations and refunds

Cancellations and refunds are subject to the order state, the conduct of the parties, the evidence available, and platform review. Refunds are not automatic merely because a party requests them. KrptoPay may determine whether wallet balance, escrow, or pending payout should be adjusted in line with the final outcome.

9.4 Disputes

KrptoPay may review disputes and issue outcomes based on platform records, user communications, delivery history, verification status, and available evidence. Users must cooperate with dispute review requests in a timely manner.

10. Fees, Taxes, and Payouts

Fees may apply to deposits, withdrawals, exchanges, P2P trades, and marketplace activity. Applicable fees are described on the Pricing page or shown before a transaction is confirmed.

Sellers are responsible for taxes, reporting obligations, and any legal requirements that apply to their marketplace income. KrptoPay may delay or hold payout where required for compliance, dispute, chargeback, fraud, or operational review.

11. Prohibited Use and Restricted Services

You may not use KrptoPay to:

  • Violate law, regulation, sanctions, or third-party rights
  • Commit fraud, deception, payment abuse, or money laundering
  • Offer unlawful, misleading, abusive, or restricted marketplace services
  • Publish infringing content, malware, credential theft, or security-bypass material
  • Manipulate reviews, disputes, ratings, wallet balances, or trade outcomes
  • Circumvent verification, moderation, geographic, or platform controls

12. Content, Listings, and Public Profiles

You retain responsibility for the content you submit, including marketplace listings, profile material, order messages, and deliveries. By submitting content to the Service, you grant KrptoPay the rights needed to host, display, review, and process that content in connection with operating the Service.

Seller handles, public profile details, listings, ratings, and reviews may be displayed publicly on marketplace pages. Do not submit information to public fields that you do not want visible to other users or search engines.

13. Enterprise and Company Wallet Engagement

KrptoPay may provide company custodial wallet onboarding, implementation planning, or related enterprise services. Unless separately agreed in writing, public website content describing enterprise services does not create a commitment to provide a specific API, service level, feature timeline, or dedicated support arrangement.

14. Suspension, Termination, and Holds

We may suspend access, freeze certain actions, place holds on transactions or payouts, delist marketplace content, or terminate accounts where necessary for compliance, risk, abuse, fraud, dispute handling, security, chargeback exposure, or operational integrity.

15. Risk Disclosures and Disclaimers

Digital asset activity involves legal, technical, market, and operational risk. KrptoPay does not provide legal, tax, accounting, or investment advice. Marketplace outcomes also involve counterparty risk between buyers and sellers.

16. Limitation of Liability

To the maximum extent permitted by law, KrptoPay and its affiliates, officers, employees, and service providers are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, opportunity, goodwill, data, digital assets, or business value arising out of or related to the Service.

17. Changes to These Terms

We may update these Terms from time to time. If we do, we will update the Last Updated date above. Continued use of the Service after updated Terms take effect means you accept the revised Terms.

18. Governing Law and Contact

These Terms are governed by the laws of Saint Lucia, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
